These Terms of Use (the “Terms”) constitute a binding and enforceable legal contract between OPOOBO Global Services Company Limited (the “Administrator”, “we”, “us”) and you. Please read these Terms carefully. Your access and use of the OPOOBO Market website (opoobo.market) and mobile application, as well as any service, content, and data available via them (together, the “Service” or the “Platform”) are governed by these Terms. If you do not agree with any part of these Terms, or if you are not eligible or authorized to be bound by the Terms, then do not access or use the Service. Please also review our Privacy Policy. The terms of the Privacy Policy and other supplemental terms, rules, policies, or documents that may be posted on the Platform from time to time are hereby expressly incorporated herein by reference. We reserve the right to make changes to these Terms at any time, with or without notice.
ALL SERVICES PROVIDED BY THE ADMINISTRATOR ARE PROVIDED 'AS IS', 'AS AVAILABLE', AND 'WITH ALL FAULTS'. THE ADMINISTRATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. ADMINISTRATOR MAKES NO GUARANTEES REGARDING THE QUALITY, LEGALITY, OR SAFETY OF PRODUCTS OR SERVICES PUBLISHED BY USERS.
To use certain features of the Service, you may need to create an account ('Account') and provide accurate information. You agree to maintain the confidentiality of your credentials and are responsible for all activities under your Account. The Administrator reserves the right to suspend or terminate your Account under certain circumstances, such as suspicious activity or breach of Terms.
OPOOBO Market is a platform for users to post and view advertisements. The Administrator is not a party to any transaction between users and is not responsible for the quality, legality, or delivery of any goods or services listed. Users are responsible for any applicable taxes. We reserve the right to remove content that violates our Terms or the law.
Users must provide complete and accurate details when posting announcements, including reachable contact information. Prices must be clearly stated. Video uploads via YouTube or Facebook APIs are subject to those platforms’ terms of use.
The Service is generally free, though some features may be paid. We reserve the right to change pricing or limit free services. Fees are non-refundable unless required by law. Payments are governed by our Billing Policy.
By using the Service, you represent and warrant that you are at least 18 years of age, or supervised by a guardian if a minor. You will comply with all laws, will not post prohibited content, and will not use the Service for any unlawful purposes.
You agree to indemnify and hold harmless the Administrator and its affiliates from any claims, losses, or damages arising from your use of the Service, your content, or your violation of these Terms or applicable laws.
IN NO EVENT SHALL THE ADMINISTRATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LIABILITY SHALL NOT EXCEED NGN37,000 OR AMOUNTS PAID BY YOU IN THE PREVIOUS 6 MONTHS.
User-generated content remains your property, but you grant the Administrator a non-exclusive, worldwide, royalty-free license to use such content for the purposes of operating and marketing the Service. Unauthorized use of any content, logos, or trademarks is prohibited.
If you believe your intellectual property rights have been infringed, you may send notice to compliance@opoobogroup.com including your contact details, a description of the rights allegedly infringed, and any supporting documentation.
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved by arbitration in Lagos under the Arbitration and Conciliation Act, in English language, by one arbitrator.
If any part of these Terms is held to be unenforceable, the remainder shall remain in effect. We may assign our rights without restriction. Our failure to act in response to a breach does not waive our rights.
